Policy
With the approval of the Office of the Attorney General (OAG) and in accordance with Subchapter D of Texas Government Code 2254, the Department of Family and Protective Services (DFPS) can enter into outside legal services contracts, which are also referred to as Outside Counsel Contracts (OC-Contract).
Texas Government Code Section 402.0212 establishes deadlines for DFPS to submit OC-Contracts and invoices that result from them for review and approval to the OAG.
DFPS Office of General Counsel must submit the invoice to the Attorney General no later than 25 days after the date DFPS receives the invoice, unless DFPS disputes the invoice. If the OAG does not approve the OC-Contract, then it must provide DFPS with written notice of the reason it was not approved. The OAG can require DFPS to competitively procure an OC-Contract.
